Abstract

Abstract

The state of the Corona Virus Disease 2019 (Covid-19) pandemic has had a negative impact on the implementation of international business dispute forums in Indonesia. It is undeniable that international business disputes are increasing due to the increasing number of creditors who are unable to fulfill their achievements in the midst of implementing strict health protocols that do not allow optimal face-to-face processes. The increase in the number of creditors also encourages alternative business dispute resolution models to be more efficient in their implementation. This research is normative legal research that uses a statutory and conceptual approach. Based on the results of the study, the litigation route for resolving international business disputes in Indonesia is not sufficient to respond to a special pandemic situation. In addition, the path of dispute resolution outside the court is also not optimal by applying the hybrid arbitration model. This is because there is no legal instrument that specifically regulates this matter. The modification of the hybrid arbitration model into online hybrid arbitration can theoretically encourage the strengthening of efficient international business dispute resolution during the pandemic.

Keadaan pandemi Corona Virus Disease 2019 (Covid-19) memberikan dampak negatif terhadap penyelenggaraan forum sengketa bisnis internasional di Indonesia. Adapun tidak dapat dipungkiri bahwa sengketa bisnis internasional meningkat karena bertambahnya jumlah kreditur yang tidak mampu memenuhi prestasinya di tengah penerapan protokol kesehatan secara ketat yang tidak memungkinkan proses tatap muka secara optimal. Peningkatan jumlah kreditur tersebut juga turut mendorong model alternatif penyelesaian sengketa bisnis untuk lebih efisien dalam penerapannya. Penelitian ini merupakan penelitian hukum normatif yang menggunakan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Berdasarkan hasil penelitian, jalur penyelesaian sengketa bisnis internasional di Indonesia secara litigasi belum memadai untuk merespons keadaan pandemi yang bersifat khusus. Selain itu, jalur penyelesaian sengketa di luar pengadilan juga belum optimal menerapkan model hybrid arbitration. Hal ini disebabkan karena belum terdapat perangkat hukum yang khusus mengatur hal tersebut. Adapun modifikasi model hybrid arbitration menjadi online hybrid arbitration secara teoretis dapat mendorong penguatan penyelesaian sengketa bisnis internasional secara efisien pada masa pandemi.
