Abstract

This research studies the Sasi traditional value in the Maluku Tengah adat community and investigates its possible role in reshaping and renewing Indonesian national criminal law. Sasi is a collection of regulation that is formed by member of adat community. Failure to comply with sasi would be punished according to the relevant sasi regulations. The drafting of a new national penal code that extend the punishable offense to include those regulated by adat and religious law as long as positive law has not regulated the offense is expected to serve the society’s legal awareness.
