INKORPORASI ‘QAWAIDH FIQHIYYAH’ PADA BAB ‘ASAS HUKUM’ DALAM MATA KULIAH PENGANTAR ILMU HUKUM

Abstract


Abstract

In the Indonesian legal education, a large portion of the materials is Western-Secular products. This research highlights fundamental courses of Indonesian legal education, especially Introduction to Jurisprudence (PIH), precisely the “principles of law” (asas-asas hukum”) chapter. This research primarily uses a doctrinal method, and this research compares the teaching of the “principles of law” chapter in PIH and Qawaidh Fiqhiyyah in Fiqh. The result of this research shows that both materials are parallel to each other, and Qawaidh Fiqhiyyah can be incorporated into the teaching of the “principles of law” chapter of the PIH course. 

 

Intisari

Pendidikan hukum di Indonesia hampir seluruh isinya merupakan produk Barat-Sekuler. Penelitian ini menyorot mata kuliah yang mendasar pada pendidikan hukum Indonesia, yakni Pengantar Ilmu Hukum (PIH), lebih khususnya terkait Bab ‘Asas Hukum’. Penelitian ini menggunakan metode doktrinal (dan mengambil data empiris sebagai penunjang), serta penelitian ini membandingkan pengajaran Bab Asas Hukum pada PIH dengan Qawaidh Fiqhiyyah pada ilmu fiqih. Hasil penelitian menemukan bahwa substansi keduanya paralel satu sama lain dan ditemukan bahwa Qawaidh Fiqhiyyah dapat diinkorporasikan pada pengajaran Bab Asas Hukum pada mata kuliah PIH.
