Abstrak

Artikel ini diawali dengan refleksi singkat atas putusan pengadilan terkait konflik antara masyarakat adat Awyu di Papua dan perusahaan kelapa sawit. Dengan menggunakan kajian kritis terhadap putusan pengadilan, penelitian ini mengungkapkan bahwa mobilisasi hukum yang dilakukan oleh masyarakat adat Awyu tidak semata-mata tentang identitas atau lingkungan. Mobilisasi tersebut harus dilihat sebagai perjuangan kelas untuk menghadapi kapitalisme ekstraktif di wilayah adat Awyu. Menanggapi perjuangan tersebut, pengadilan telah menolak untuk terlibat dengan wacana identitas Awyu yang melekat dengan lingkungan dan mata pencaharian mereka. Penolakan ini menunjukkan bagaimana identitas masyarakat adat dapat menjadi batu sandungan bagi proyek-proyek ekstraktif yang didukung oleh negara. Artikel ini berpendapat bahwa kegagalan pengadilan untuk mempertimbangkan identitas sebagai bagian dari konstruksi hubungan hukum antara masyarakat adat dengan lingkungan mereka dapat menyebabkan kegagalan hukum lingkungan untuk mewujudkan keadilan antar-generasi.
