Abstract


Abstract
This study discusses on the implementation of Prior Informed Consent (PIC) and Access and Benefit Sharing System (ABS) in the Effort to Optimalize Bioprospecting of Genetic Resources in Indonesian Seas. The questions posed are (1) how is the implementation of the aforementioned PIC and ABS as a protection of genetic resources coming from Indonesian seas? (2) How is the implication of the PIC and ABS implementation in the bioprospecting of genetic resource in Indonesian seas towards the urgency of the passing of Genetic Resources Management bill? The result shows that PIC and ABS implementation is not optimally protecting genetic resources from biopiracy, misuse, and misappropriation.

Penelitian ini membahas mengenai impelementasi Prior Informed Consent (PIC) dan Access and Benefit  Sharing System (ABS) dalam Upaya Optimalisasi Bioprospeksi Sumber Daya Genetik di Kawasan Laut Indonesia. Rumusan masalah yang dikemukakan adalah (1) bagaimana implementasi PIC dan ABS sebagai bentuk perlindungan sumber daya genetik yang berasal dari wilayah laut Indonesia? (2) bagaimana dampak dari implementasi PICdan ABS dalam bioprospeksi sumber daya genetik laut di Indonesia terhadap urgensi pengesahan RUU Pengelolaan Sumber Daya Genetik (RUU PSDG)? Kesimpulan yang diperoleh adalah implementasi mekanisme PIC dan ABS yang diusung oleh CBD bersama aturan derivatifnya, belum secara optimal melindungi bioprospeksi sumber daya genetik laut di Indonesia dari biopiracy, misuse, dan missappropriation oleh pihak-pihak asing yang tidak bertanggung jawab
